Terms and Conditions

1 Scope

The business relationship between Bellefiore GmbH (hereinafter "Bellefiore") and the Customer, the following terms and conditions applicable at the time the order is placed, it will be delivered to the customer together with the summary of his order, in an e-mail.

2 Conclusion

An order placed by you constitutes an offer to us to conclude a contract of sale

If you place an order, we will send you an e-mail confirming receipt of your order and its details (order confirmation). This order confirmation does not constitute nor any acceptance of your offer, but is only to inform you that your order is received. If the payment process has worked properly, please e-mail a change in status of your order marked "payment received / payment received".

A purchase contract is concluded, however, always only when we send the ordered product to you and confirm the shipment to you with another e-mail with the words "shipped / Shipped" (shipment confirmation). 

Bellefiore does not sell products for purchase by children. Our products for children can only be purchased by adults.

Please note that we sell all products only in small quantities. This refers to the number of products ordered under an order and to the several orders of the same product, including where the individual orders the usual quantity.

3 Cancellation:

Withdrawal up to 2 weeks.

a Withdrawal

You can cancel your contract within two weeks without giving reasons in writing (eg letter, e-mail) or - if the goods are delivered before the deadline - by returning the goods.

The time limit begins after receipt of this notice in written form, but not before receipt of the goods to the consignee (in case of recurring deliveries of similar goods not before receipt of the first partial delivery) and also does not fulfill our obligations. The revocation period is sufficient to send the revocation or the goods.

b. Consequences

4 Delivery

Unless otherwise agreed, the delivery from the warehouse of Bellefiore at the customer's delivery address. On the website you will find information on availability of products that are sold directly by Bellefiore (eg on the product detail page). We note that all details are available, shipment or delivery of a product only estimated times and approximate values. They are not mandatory or guaranteed shipping or delivery dates, unless it is in the shipping options of each product expressly designated as binding deadlines. If Bellefiore during the processing of your order notes that you have ordered products are not available, you will be notified separately by e-mail. If Bellefiore no fault of their own to deliver the ordered goods are not in a position, because the supplier of Bellefiore its contractual obligations are not met, Bellefiore, the purchaser shall be entitled to resign over. In this case, the customer will be informed that the product is not available. The legal rights of the customer remain untouched.

5 Due date and payment arrears

The Purchaser shall pay the purchase price to basically credit card. In special cases, we also sell on account. If the buyer defaults, then Bellefiore is entitled to charge default interest at a rate of 5% per annum. Further damages is reserved.

6 Characteristics of purchasing and accounting

Payment on account is only possible in special cases and after ausdr├╝cklilcher written agreement. The shipping address and billing address must be identical and within Switzerland. The balance is due 10 days after receipt of invoice.

7 Prices

Include for national sales in Switzerland (sellers and buyers as well as delivery within Switzerland) All prices quoted the applicable value added tax (prices including VAT).

For all sales abroad, the prices are excl of understanding in the country of any applicable VAT and import tariffs (prices enkl VAT.), And the purchaser is hereby again expressly pointed out that this - if the authorities of the respective country collected - paid directly from Him.

8 Retention of title

The delivered goods until full payment of the property of Bellefiore.

9 Liability

If there is a shortage of the goods prior to apply the statutory provisions under Swiss law. The assignment of these claims is excluded.

Bellefiore has unlimited liability to the extent that damage is caused by intent or gross negligence.

If Bellefiore negligently violated a contractual obligation to indemnify for damages to the typical damage is limited.

If the remedy is by way of replacement, the customer is obligated to return the original goods within 30 days at Bellefiore on costs. The return of defective merchandise must be in accordance with statutory requirements. Bellefiore reserves the right to claim compensation under the statutory provisions.

The limitation period is twenty-four months, and begins with der Lieferung.

Unless otherwise stated above, any further claims by the customer - for whatever legal reasons - are excluded. Bellefiore is not liable for damages not caused to the goods themselves, especially Bellefiore not liable for lost profits or other financial damages of the customer. Where the contractual liability is excluded or limited by Bellefiore, this also applies to the personal liability of employees, representatives and agents.

10 Jurisdiction and applicable law

It is exclusively governed by Swiss law. The jurisdiction is determined by federal law from 24th March 2000 on jurisdiction in civil matters (Jurisdiction Act).
